Excel Marine
These Terms & Conditions apply to your use of our website and the purchase of any products from Excel Marine. By placing an order, you agree to be bound by these terms. These terms do not affect your statutory rights under UK law, including the Consumer Rights Act 2015.
1. Orders & Pre-Orders
1.1 Order Acceptance
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including in cases of stock discrepancies, pricing errors, or suspected fraudulent activity.
1.2 Pre-Orders & Deposits
Deposits for pre-orders are non-refundable unless we cancel the order.
Any estimated lead times are provided as guidance only and are not guaranteed.
1.3 Stock Availability & Substitutions
In the event of stock discrepancies or supplier issues, we reserve the right to:
- Offer a suitable alternative product
- Revise estimated lead times
- Cancel the order and issue a full refund
We will always contact you before proceeding with any alternative.
2. Cancellation
2.1 Before Dispatch
Orders may be cancelled before dispatch for a full refund. A restocking fee may apply to certain items.
2.2 After Dispatch
If your order has been dispatched, cancellation will fall under our returns policy.
2.3 Engines & Rigged Packages
Outboard engines are typically warranty registered prior to dispatch. Any cancellation or return after dispatch will incur:
- £75 administration fee (warranty adjustment)
- 10% restocking fee
Where products have been rigged, modified, or built to specification, cancellation may not be possible or may incur additional costs.
3. Delivery
3.1 Delivery Times
We aim to dispatch orders promptly; however:
- Delivery times are estimates only
- Delays caused by couriers or suppliers are outside our control
We are not liable for any indirect or consequential losses arising from delivery delays.
3.2 Risk & Ownership
Goods remain our responsibility until delivered to you.
Risk transfers upon successful delivery.
3.3 Failed Deliveries
If the courier is unable to complete delivery after two attempted deliveries, any further re-delivery, storage, or return charges will be the responsibility of the customer.
We will make reasonable efforts to coordinate a suitable delivery date with you and the courier; however, this cannot be guaranteed and remains subject to courier availability. It is the customer’s responsibility to ensure that delivery can be accepted at the agreed time and location.
4. Returns, Refunds & Faulty Goods
4.1 Faulty Goods (0–30 Days)
If you believe an item is faulty, please contact us within 7 days of receipt of goods so we can assess the issue and advise on the next steps.
Once notified, you have up to 30 days from receipt to return the item. Depending on the nature of the issue, we will offer an appropriate resolution, which may include a repair, replacement, or refund in line with your statutory rights.
In most cases, you will be asked to return the item to us for inspection. If the item is confirmed to be faulty, we will reimburse reasonable return postage costs.
If, following inspection, the item is not found to be faulty or the issue is determined to be outside of warranty (for example due to misuse or normal wear), the return will be handled under our non-faulty returns policy.
4.2 Faulty Goods (After 30 Days)
If a fault develops after the initial 30-day period, please contact us and we will guide you through the next steps.
All warranty claims are handled on a back-to-base basis, meaning the customer is responsible for returning the item to us for inspection. Once received, a condition report will be carried out to assess the fault and determine the appropriate course of action.
Where a fault is confirmed and covered under warranty, we will typically attempt a repair in the first instance. If a repair is not viable or appropriate, we may offer a replacement, alternative product, or another suitable resolution depending on the circumstances.
All outcomes will be considered in line with the Consumer Rights Act 2015 and the specific nature, age, and use of the product.
4.3 Non-Faulty Returns
If you wish to return an item that is not faulty, please contact us within 14 days of delivery so we can guide you through the returns process.
To be eligible for a return, items must be unused, in their original packaging, and in a condition suitable for resale. We recommend returning items via a tracked service and retaining proof of postage.
Once the item has been received and inspected, we will process your refund to the original payment method. Where applicable, deductions may be made to reflect any reduction in value resulting from handling beyond what would be expected to establish the nature and characteristics of the goods.
4.4 Inspection
All returned items are subject to inspection upon receipt.
If an item is returned as faulty but is found not to have a fault, or the issue falls outside of warranty conditions, we will contact you to confirm the next steps. This may include returning the item to you or processing it under our non-faulty returns policy.
5. Consumer Cancellation Rights (Distance Selling)
Under the Consumer Contracts Regulations 2013:
- You have 14 days from delivery to cancel your order
- You then have 14 days to return the goods
Conditions:
- Items must be unused and in original condition
- Refunds exclude enhanced delivery services
6. Warranty
6.1 Boats
All Excel Marine inflatable boats are supplied with a standard 12-month warranty from the date of purchase.
For leisure (non-commercial) use, customers may qualify for an extended 5-year warranty by registering the product within 30 days of purchase via our online registration form or by contacting us directly.
For commercial use, a 12-month standard warranty applies. By registering the product within 30 days of purchase, this can be extended to a 2-year commercial warranty.
If the product is not registered within this timeframe, warranty coverage will remain limited to the initial 12-month period, and any repairs or services requested after this period may be chargeable.
All warranties are provided on a back-to-base basis, meaning the customer is responsible for returning the product to us for inspection. Upon receipt, we will carry out a condition assessment and determine the appropriate course of action, which may include repair, replacement, or an alternative resolution depending on the nature of the issue.
6.2 Engines
Engine warranties are provided by the relevant manufacturer and are subject to the manufacturer’s terms and conditions.
As an authorised dealer, Excel Marine can assist in liaising with the manufacturer regarding any warranty claims and help facilitate the process on your behalf.
However, all warranty assessments, approvals, and final decisions remain at the discretion of the engine manufacturer.
6.3 Warranty Limitations
Warranty does not cover:
- Misuse or use outside intended purpose
- Incorrect installation or handling
- Damage caused by poor storage or maintenance
- Normal wear and tear
- Commercial use unless explicitly stated
6.4 Back-to-Base Warranty
Warranty claims are return-to-base:
- Customers are responsible for returning items
- Transport costs may apply unless otherwise agreed
7. Product Use & Responsibility
Customers are responsible for ensuring products are:
- Used in accordance with manufacturer guidelines
- Suitable for their intended use
We are not liable for damage resulting from improper use or installation.
8. Pricing & Payment
- All prices include VAT (where applicable)
- Payment is taken at checkout
- We reserve the right to cancel orders due to pricing errors
9. Product Descriptions
- Images are for illustrative purposes only
- Specifications, colours, and materials may vary
- Accessories shown may not be included
Customers should contact us for clarification prior to purchase if required.
10. Limitation of Liability
To the fullest extent permitted by law, Excel Marine shall not be liable for:
- Indirect or consequential losses
- Loss of income, business, or use
- Delays outside our reasonable control
Nothing in these terms limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
11. Website Use & Intellectual Property
All content on this website, including but not limited to text, images, graphics, logos, and product descriptions, is the property of Excel Marine or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, republish, or commercially exploit any content from this website without our prior written consent.
Unauthorised use of this website or its content may result in access being restricted and may give rise to a claim for damages and/or constitute a criminal offence.
12. Privacy
We take your privacy seriously. Your personal data will be processed in accordance with applicable data protection laws and used for purposes including processing your order, providing customer support, managing warranties and services, and improving our products and services.
We are fully compliant with the UK GDPR and the Data Protection Act 2018.

13. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales.
